OPINION

CHIN, District Judge.

In these related cases, plaintiffs 1 are information providers (“IPs”) that produce the recorded “telephone mass announcement” programs accessed by the public through 976 telephone numbers. Plaintiffs allege that defendants NYNEX Corporation and New York Telephone Company (together, “NYTel”) engaged in gross negligence and wilful misconduct in 1990 when NYTel unilaterally implemented what the parties have referred to as the “Ericsson cutover” — a change in the equipment used to process the 976 telephone calls.
