This action is in the nature of a suit for the malicious prosecution of civil proceedings.
The petition states substantially: That on November 1, 1907, the defendant maliciously, wantonly, and oppressively filed in the office of the clerk of the district court of Garfield county a false, fraudulent and fictitious mechanic’s and materialman's lien against certain real property of plaintiffs.
