KOSCINSKI, District Judge.

This is a suit for trade-mark infringement and unfair competition in which plaintiffs also seek reversal of a Patent Office decision accepting for registration defendant’s application for an alleged infringing trade-mark.

On October 13, 1945 defendant filed an application in the United States Patent Office, Serial No. 489,918, for registration of its trade-mark Rustaboo for a chemical and detergent preparation for cleaning and preparing metal surfaces for painting.
