FEINBERG, Circuit Judge:

Louis A. Ferrara appeals from a judgment of the United States District Court for the District of Vermont, Fred I. Parker, J., convicting Ferrara of bank fraud after a guilty plea pursuant to a plea agreement. In April 1991, the judge sentenced Ferrara to five years in prison, the maximum under the statute at the time of the offense, to commence the day of sentencing and to run concurrently with a 36-month federal sentence Ferrara was then serving.
