By this bill for an injunction the appellant railway company sought to restrain the city of Chicago from prosecuting its petition for the condemnation of a strip of land which is a part of the right of way of the company. The land in question is within the limits of Chicago, and within the former corporate limits of the municipal corporation known as the town of Lake. The proposed condemnation was for the purpose of opening and extending Sixtieth street.
