Facts of Case

This case involves a dispute over the title to a strip of real property near an irrigation canal. The Selah Moxee Irrigation District contends that it holds a right of way extending 50 feet in each direction from the center of an irrigation canal which it operates in Yakima County. Mary Kesinger 1 holds an interest in certain property adjacent to this canal and maintains that the irrigation district's right of way extends only 30, not 50, feet from the canal.
