Two motions are currently pending in this court for decision. Defendant Obie Payton has moved to dismiss the case for lack of subject matter jurisdiction, and plaintiffs Beneficial National Bank, U.S.A. (Beneficial) and Household Bank (SB), N.A. (Household) have moved to compel arbitration pursuant to § 4 of the Federal Arbitration Act (FAA), 9 U.S.C. § 4.
