Diana and Randall Clark filed a complaint in the Circuit Court of Jackson County against Mobile Home Brokers, Inc., a corporation, for breach of an implied warranty of merchantability (Title 7A, Section 2-314, Code of Alabama 1940 [Recomp. 1958]). The warranties allegedly were made when Mobile Home Brokers sold, through their agent Crestview Mobile Homes, a new Olympic mobile home to the Clarks.
