The complaint in this action, in legal effect, states a cause of action against the defendants to quiet title to a tract of land. The defendant Donegan was made a party to answer as to a possible interest, which it appears he did not have, and no further reference need be made to him in Ms character as a party. The action was tried by the court upon an agreed statement of facts which stands in lieu of findings; judgment was given declaring that the plaintiffs were the owners in fee of the land, and that, upon the payment by plaintiffs to the defendant Witmer, or into court for him, of the sum…
