McCLOSKY, J.

Plaintiff Balboa Insurance Company appeals from the judgment of dismissal. That judgment followed the court’s granting the motion of defendants John Aguirre and Marilyn Aguirre to dismiss this action pursuant to Code of Civil Procedure section 583, subdivision (d) 1 for failure to bring it to trial within three years after entry of any order of the court declaring a mistrial.
