These two cases, in which the parties are substantially the same, are here on error, and have been submitted upon a motion to strike the bill of exceptions, and to dismiss the proceedings in each case, and, subject to the disposition of that motion, upon the merits. The facts as to the bill of exceptions are the same in each case, and the motion to strike the same.
