United States v. Carmen A. Tortora
Court of Appeals for the First Circuit
1Opinion of the Court
SELYA, Circuit Judge.
The government appeals an order of the United States District Court for the District of Massachusetts releasing defendant-*882appellee Carmen A. Tortora from pretrial detention. The applicable bail statute provides in relevant part that if a “judicial officer finds that no condition or combination of conditions will reasonably assure ... the safety of any other person and the community,” the judicial officer shall order the defendant detained pending trial. 18 U.S.C. § 3142(e) (1988).1 We conclude that the district court erred in ordering Torto-ra’s release.
