This is a suit instituted by ap-pellee against appellant, a married woman, her husband, Manuel Sandoval, being joined pro forma, and her son R. T. Carranza, to recover on a certain promissory note attached to and made a part of the petition. R. T. Garbanza was omitted as a party in the amended petition on the allegation that he ivas a bankrupt and a fugitive from justice whose location was unknown to appellee.
