This suit was instituted by M. D. Brazile against the United Home Builders of America, an association or society, its receiver, G. G. Wright, and John M. Scott, commissioner of insurance, for the cancellation of a promissory note and a certain mortgage on a tract or parcel of land situated in Fort Worth, claimed by him to be his homestead. The receiver filed a cross-action, as also did the commissioner of insurance. Mrs. Annie Brazile, wife of M. D. Brazile, was made a defendant in the cause.
