This is an action by the beneficiary named in the certificate issued to an employee covered by a group life insurance policy issued to the employer, the Great Atlantic Pacific Tea Company. The deceased employee was Joseph A. Nick, Jr. The cause was filed October 3, 1935, and tried February 25, 1943. Plaintiff obtained verdict and judgment for $4312.00, the face amount ($3,000) of the certificate, plus interest. Defendant appealed to the Kansas City Court of Appeals.
