Petitioner, a citizen and resident of Texas, brought this action against respondent, a Connecticut corporation, in a Texas court to recover $4,000 with interest and attorney’s fees. Respondent removed the case to the federal court for the eastern district of Texas.

The suit was to recover for permanent total disability under a policy of group insurance issued in Pennsylvania by respondent to the Gulf Oil Corporation.
