MEMORANDUM AND ORDER

SACHS, District Judge.

Plaintiffs K & K Jump Start/Chargers, Inc., and Bonnet Enterprises, LLC, brought this patent infringement action against defendant Schumacher Electric Corp. Schumacher sold a jump starter known as the “INSTANT POWER.” Bonnet owns a patent for allegedly the same device, which was invented in Canada by Karl Srol. Srol was issued- an American and Canadian patent for his device, and he assigned these to Bonnet. 1 Bonnet, in turn, granted K & K an exclusive license to manufacture, sell, and otherwise use the device.
