The following motions are pending before me: (1) a motion to compel (Filing 97), (2) a motion to stay dispositive motions pending appeal (Filing 96), (3) a motion to dismiss Count V pursuant to Federal Rule of Civil Procedure 12(b)(1) (Filing 79), and (4) a motion for summary judgment regarding Counts I, II and III submitted pursuant to Federal Rule of Civil Procedure 56 (Filing 73).
