Plaintiff appeals from a judgment dismissing his petition for a writ of habeas corpus. Plaintiff claims that he is entitled to immediate release from imprisonment because the Board of Parole and Post-Prison Supervision (Board) improperly deferred his release date. Plaintiff also contends, relying on Alexander v. Johnson, 164 Or App 235, 990 P2d 929 (1999), that the trial court erred in requiring him to pay for his attorney fees in this proceeding.
