Plaintiff petitioned for a writ of habeas corpus, asserting that he is being imprisoned unlawfully by defendant, the superintendent of the Eastern Oregon Correctional Institution. He asserts that the Board of Parole and Post-Prison Supervision (board) erred in deferring his projected parole release date to August 15, 2001, based on a finding that he suffered from a present severe emotional disturbance such as to constitute a danger to the health and safety of the community.
