ORDER
SILVER, District Judge.
Pending before the Court is Gamaliel Abaqueta’s appeal from an administrative decision of a Disciplinary Appeals Board of the United States Department of Veteran Affairs. Appellant filed a Brief on Appeal on Oct. 19, 2001 [Doc. # 31]. The government filed an Answering Brief on December 14, 2001 [Doc. #36], and Appellant filed a Reply Brief on Jan. 1, 2002 [Doc. #37]. Having reviewed the arguments and administrative record, the Court will uphold the decision of the Disciplinary Appeals Board and deny the Appeal. 1
