Appellant was charged with the crime of murder in the first degree, found guilty and sentence of death imposed. A motion for new trial was made and de nied. As no appeal was perfected from the order denying the motion for a new trial, this appeal is from the judgment.

It appears from the record that appellant and the deceased had been business associates, engaged in operating a billiard parlor in Twin Falls.
