— The appellant was tried and convicted of murder of the second degree. A motion for a new trial was made and overruled. This appeal is from the judgment and from the order overruling the motion for a new trial.

The evidence upon which appellant was convicted was wholly circumstantial, and the first question presented in appellant’s brief is the contention that the evidence is insufficient to justify the verdict. The evidence shows that Thomas Marren, the appellant, and Con. Ryan, the deceased, had for a number of years been residents on the Malad river, the appellant living on the north side…
