This cause was commenced on August 20, 1937, and the petition is in two counts, each upon a separate promissory note. The first count was to recover on a note for $1050 dated June 13, 1936, and the second was to recover on a note for $20,000 dated March 1, 1934. The cause, on the second count, has been tried twice and appealed twice. At the first trial plaintiff recovered on the first count, but lost on the second.
