Mizzie Williams recovered judgment for $2,500 in the superior court of Tulsa county, against the St. Louis & San Francisco Railroad Company and Samuel L. Fivecoat, an employee of the company, and who at the time of the injury complained of’ was running a locomotive engine, which ran over and.killed the husband of Mizzie. The defendants appeal from the judgment, and assign as error the action of the trial court as follows: (1) In overruling demurrer to plaintiff’s evidence.
