This is an appeal from a judgment of the superior court of Maricopa county, in favor of Verde Irrigation & Power District, a corporation, hereinafter called plaintiff, against Edwin T. Stewart, individually, and as State Water Commissioner. The suit was originally against Prank P. Trott, the then water commissioner, Edwin T. Stewart, his successor, being later substituted as defendant, but as the case involves only the official acts of the water commissioner, we shall use the term “defendant” as applied to both Stewart and Trott indiscriminately.
