SWEET, District Judge.

Third-party defendant John L. Johnston (“Johnston”) has moved, pursuant to Rule 12(e) of the Federal Rules of Civil Procedure, for judgment on the pleadings to dismiss the third-party complaint (the “TPC”) of defendant John D. Leahy, Jr. (“Leahy”). Leahy has moved, pursuant to Rules 15(a) and 13(f), to amend his answer to the complaint (the “Complaint”) of plaintiff Bradley N.
