I. NATURE OF CASE

This is a negligence action brought under the Political Subdivisions Tort Claims Act, Neb. Rev. Stat. § 13-901 et seq. (Reissue 1991 & Cum. Supp. 1994). Appellee, C. Patricia Skinner, sued appellant, Ogallala Public School District No. 1 (District), for injuries she suffered when she fell through a trapdoor in the floor that had been left open at the school. Both parties filed motions for summary judgment on the workers’ compensation issue, and the trial court granted summary judgment in favor of Skinner on the issue of whether the Nebraska Workers’ Compensation Act applies.…
