Petitioners are the surviving parents of Dwight Golstein II, a nine-year-old boy who died as a result of the negligent administration of an overdose of radiation while undergoing treatment for curable cancer. Petitioners seek a writ of mandate to reinstate their causes of action for negligent infliction of emotional distress. These causes of action are primarily premised upon the “bystander” recovery theory of Dillon v. Legg (1968) 68 Cal.2d 728 [69 Cal.Rptr. 72, 441 P.2d 912, 29 A.L.R.3d 1316], which permits recovery for emotional distress under certain circumstances to one…
