Affirming.

The appellant, Eugene Glisper, alias Julian Gillespie, a man of color, was indicted, tried and convicted in the Fayette circuit court for the crime of horse-stealing, and his punishment fixed hy verdict of a jury and judgment of the court at confinement in the penitentiary for a term of four years. He was refused a new trial and has appealed.
