About 11:30 p. m., June 15, 1933, Robert Miracle, a nine year old boy, was shot, and lie died therefrom in a few hours. Chester Maxey and his first cousin Walter G-aines were charged by indictment with his murder. Upon his separate trial Maxey was found guilty and his punishment fixed at imprisonment for life. He appeals.
