-Affirming.

This is an appeal from a judgment convicting appellant of manslaughter, and fixing his punishment at twenty years’ imprisonment.

The facts are these: There lived in Barthell, a mining camp in McCreary county, three namesakes of Admiral Dewey, namely Dewey Philipps, Dewey Brown, and appellant, Dewey Warman. They were all about the same age and were on friendly terms with each other.
