Appellant and his wife, in a Packard automobile, were passing .through a small city (not otherwise identified) a; few miles south of' Louisville on the evening of August 14, 1949. Appellant was fleeing from the state of Kansas to avoid confinement after conviction for- the crime of robbery. His wife was fleeing from the state of Alabama to avoid’ prosecution in the United States Courts for harboring her husband.
