This was an action brought by J. M. Doud & Co. against John J. Murray, on an alleged contract by plaintiffs to sell and of defendant to buy the product of leaf lard of the Doud packing house from November 3, 1891, to January 1, 1892, at nine cents per pound. After the alleged contract was made the price of lard declined on the market, and the defendant refused to receive six cars of lard, whereupon plaintiffs sold the lard on the market and this action was brought to recover the difference between the contract price and the amount realized on a sale at the market price.
