Two indictments were found by a grand jury against the defendant, John Lester Gregory, one indictment in two counts charging him with assault and battery and indecent ¡assault upon one Marie Harkins, and the other indictment charging him with practicing medicine and surgery, holding himself forth as such a practitioner, assuming the title of doctor of medicine and surgery, and assuming to diagnose disease by use of medicine and surgery on the body of Marie Harkins, without a license.
