The plaintiffs — an ophthalmic clinic known as the “Desniek Eye Center” after its owner, Dr. Desniek, and two ophthalmic surgeons employed by the clinic, Glazer and Simon— appeal from the dismissal of their suit against the ABC television network, a producer of the ABC program PrimeTime Live named Entine, and the program’s star reporter, Donaldson. The suit is for trespass, defamation, and other torts arising out of the production and broadcast of a program segment of PrimeTime Live that was highly critical of the Desniek Eye Center.
