This case is before the Court on the appellant’s application for an award of attorney fees and expenses under the Equal Access to Justice Act (EAJA), 28 U.S.C. § 2412. In the underlying case on the merits, the appellant appealed a May 1997 Board of Veterans’ Appeals (BVA or Board) decision which found that he had not submitted new and material evidence *471in order to reopen his claim for a mental disorder.
