This cause is before the Court on Defendants’ Motion to Dismiss The Consolidated Complaint [Docket No. 39], filed on February 23, 2009; and Defendants’ Motion for Oral Argument [Docket No. 48], filed on May 26, 2009. In the Motion to Dismiss, Defendants contend that the consolidated Complaint cannot withstand scrutiny under the heightened pleading requirements applicable to securities fraud litigation.
