This action is brought pursuant to section 434a-20.0 of the Administrative Code of the City of New York by 11 members of the Police Department of the city to recover full pay for the periods when each of them was suspended by the commissioner without pay pending trial of charges, on which charges plaintiffs claim they were not convicted. The plaintiffs have moved for summary judgment and for judgment on the pleadings in pursuance of rules 113 and 112 of the Rules of Civil Practice, and the defendant has cross-moved for judgment pursuant to rules 112 and 113.
