MEMORANDUM OPINION AND ORDER
BRUCE R. THOMPSON, District Judge.
This cause is before the Court on the defendant’s motion to dismiss Counts I-V of the complaint for failure to state claims upon which relief can be granted and defendant’s motion to stay proceedings pending arbitration.
The complaint states seven counts under federal and state securities laws, federal commodities laws and common law dealing with Merrill Lynch’s allegedly careless and fraudulent activity in handling the plaintiff’s accounts.
