BLACKBIRD, Justice.

Plaintiff in error and defendant in error were “defendant” and “plaintiff”, respectively, in the trial court, and will hereinafter be referred to as such. Plaintiff was a welder for Wilson & Company, which engaged defendant, as an independent contractor, to perform certain construction and repairs at its Oklahoma City packing plant. In this action, plaintiff sought damages from defendant for injuries he allegedly received from an accident which occurred during the progress of such construction and repairs.
