This action was brought in the district court of Oklahoma county by 'Collins-Dietz-Morris Company, a corporation, plaintiff in the trial court, defendant in error herein, against the city of Oklahoma City, a municipal corporation, plaintiff in error herein, defendant in the trial court, for damages. The parties will hereinafter be referred to as they appeared in the lower court.
