WILLIAMS, Vice Chief Justice.

This action was commenced by the Board of County Commissioners of Oklahoma County, hereinafter referred to as plaintiff, against Robert W. Finley and others, hereinafter referred to as defendants, to condemn .22 acres of land for highway and road purposes. Defendants are the owners of the Rail Fence Tourist Court located south of Oklahoma City on the west side of U. S.
