Tbe defendant executed bis promissory note to tbe Hardware Company of Louisburg, N. 0., wbo indorsed it to tbe plaintiff. Tbe plaintiff alleged tbat it was a corporation doing business under tbe laws of tbe State of Alabama. In tbe answer tbe defendant admitted tbe execution and delivery of tbe note, but denied tbe incorporation of tbe plaintiff and tbe assignment to it of tbe note. On tbe trial tbe defendant introduced no evidence, but objected to tbe deposition of A. R. Eorsytb, wbo testified tbat be was vice president and treasurer of tbe plaintiff, tbat it is a corporation under the laws…
