John M. Weisbrod died a widower on December 21, 1935, leaving surviving him six children, George Weisbrod, David K. Weisbrod, Augusta Weisbrod Foster, Moritz Weisbrod, Ellen Weisbrod and Walter Weisbrod, as well as the four minor children of a daughter who had predeceased him. Of these the first four are plaintiffs and appellants in the present action, Moritz, who is an incompetent, appearing by Security Trust and Savings Bank, a corporation, as his guardian.
