Appeal by defendants from a judgment in favor of plaintiff for $25,000 entered upon a verdict of a jury in an action based upon the alleged appropriation by defendants of a radio program and format which plaintiff claims to have originated.

The complaint contains two causes of action. The first, based upon the alleged plagiarism of a common-law copyright, alleges that: during 1944 plaintiff “originated and caused to be prepared and composed and written an original script and radio program format for a radio program entitled ‘Your Heart’s Desire,’ ” and caused the script to be transcribed upon…
