Pending before this court is the motion by the plaintiff, Robert L. Loeh (“plaintiff’ or “Loeh”), for the court to reconsider its Sep*107tember 15, 2006 decision granting the motion by the United States (“government”) to dismiss the plaintiffs claim for failure to state a claim. In its decision, the court held that Mr. Loeh was not entitled to retirement pay because he had been dismissed from the United States Navy (“Navy”) pursuant to his court-martial sentence.…
