VALLÉE, J.

Plaintiff and cross-defendant appeals from an order denying his motion to set aside an interlocutory decree of divorce.

An action for divorce- on the ground of extreme cruelty was filed by plaintiff on June 18,1945. The complaint alleged that plaintiff and defendant were married in Los Angeles County, California, on February 5, 1945; that they separated on June 1, 1945; that there were two children, the issue of the union.
