MEMORANDUM OPINION
ROYCE C. LAMBERTH, District Judge.
This matter comes before the Court on cross-motions for summary judgment. Upon consideration of the motions, the oppositions and replies thereto, the applicable law, and the record herein, this Court determines that defendant’s Motion [11] for Summary Judgment should be GRANTED and plaintiffs Cross-Motion [20] should be. DENIED.
