Plaintiff sued to recover damages for breach of a contract by which' the defendant agreed to convey to her certain real property in the borough of Manhattan, city of New York. The issues in the case were tried before a jury and resulted in a verdict for the defendant. The Appellate Division has reversed the judgment entered upon the verdict, stating in the order that the reversal was upon the law and the facts, and granted a new trial, with costs to abide the event.
